Services include all family law matters, in all courts of the State of Arizona. These include:
- Divorce, Separation and Paternity
Divorce and Separation include pre divorce counseling, filing, negotiating a settlement on the division of assets and debts, establishment of current and past child support, establishment of spousal maintenance, child custody (whether sole custody or joint custody), parenting time (formerly visitation), and attorney fees (i.e. obtaining fees from the other party). Paternity is similar to the above but addresses establishing paternity (thru DNA testing if necessary), custody, parenting time, current and past child support, past non-covered medical expenses of the mother during the pregnancy and non-covered medical expenses of the child from date of birth to time of hearing, and attorney fees and costs.
- Division of Assets and Debts
Includes determination of sole and separate assets and debts vs community assets and debts, and allocation of assets and debts between the parties.
- Child Support, Modification and Enforcement
Includes the initial and post decree calculation together with consideration of day care, medical insurance premiums, division of non covered medical expenses of the children, and allocation of the tax exemption for federal income tax purposes. Modification and Enforcement includes the calculation of and collection of child support post decree – including filing contempt proceedings requesting incarceration for non payment.
- Spousal Maintenance Establishment Modification and Enforcement
Includes the initial (qualification for and length of) and and post decree calculation and order for same. Modification and Enforcement include changing a spousal maintenance order and enforcing the collection of same – including filing contempt proceedings requesting incarceration for non payment.
- Grandparent Custody and Visitation
Includes obtaining custody of grandchild or in the alternative obtaining visitation with the grandchild.
- Relocation Issues
Includes the notice requirements of relocation, notices to be given, and court action when necessary to obtain permission to relocate children.
- Prenuptial, Postnuptial and Cohabitation Agreements
Includes counseling of when such agreements would be advisable, the terms of same and the requirements necessary to execute a valid agreement.
- Orders of Protection
Includes obtaining orders of protection and injunctions prohibiting harassment, the court appearance necessary to obtain same and the requirement of appear and defend the need for same if a hearing is requested. Contesting an order of protection includes the need for a request for a hearing and what occurs at the hearing.
- Interstate Custody, Visitation and Child Support Issues
Includes what is required when there is an out of state order for custody, visitation or child support for purposes of modification of custody or enforcement of visitation and child support. This discussion will include the Uniform Child Custody Jurisdiction and Enforcement Act (UCCJEA) and the Uniform Interstate Family Support Act (UIFSA)
- Wills, Medical Powers of Attorney and Living Wills
Includes the need for these documents during or after a family court proceeding, the terms of same and the preparation and execution of same.
